BREA CALIFORNIA RESIDENTIAL RENTAL REQUIREMENTS & LAWS

Last updated October 20, 2026

Because local requirements and statewide rental laws may affect how a property is rented and operated, these are the laws I refer to when working with residential rental-property in Brea, California.

1. City of Brea: Local Rental Requirements

  • Short-term rentals: Municipal Code Chapter 5.32: In 2026, Brea established a limited short-term rental pilot program allowing up to 100 licensed properties. Owners must obtain the required city licenses and comply with applicable operating requirements.
  • Rental-property business licensing: Municipal Code Title 5: Brea's business-license provisions address residential rental activities, including apartments. Owners should confirm the licensing requirements for their particular property with the city.
  • Accessory dwelling units (ADUs): Municipal Code Chapter 20.52: ADUs and junior ADUs used as rental units must generally be rented for at least 30 consecutive days. Additional requirements may apply to junior ADUs.

2. California Statewide Rental Requirements

These generally apply throughout California, including Brea, where the property is covered.

  • AB 1482: Civil Code §§ 1947.12 and 1946.2: Rent increase limits and just-cause protections.
  • AB 12: Civil Code § 1950.5: Security-deposit limits.
  • AB 2801: Civil Code § 1950.5: Security-deposit photographic documentation.
  • AB 628: Civil Code § 1941.1: Habitability requirements, including working stoves and refrigerators.

Whether these local and state requirements apply depends on your property's type, location, and circumstances. If you have questions about your specific rental property, feel free to reach out to me.

3. How I help Brea Landlords

As a California residential real estate professional since 1997 and a rental-property owner myself, I provide rental and property management assistance to independent landlords with:

  • Move-out and pre-move-out inspections.
  • Security-deposit documentation.
  • Rental preparation and advertising.
  • Applicant screening and tenant placement.
  • Leasing disclosures and move-in coordination.

You can continue managing your property yourself without committing to ongoing property management.

In my professional experience, Brea has been a desirable residential rental market, with established residential neighborhoods, newer housing developments, and a strong shopping and business community.

One of the biggest changes underway is the redevelopment of Brea Mall, which will introduce new rental apartments, restaurants, retail, and community gathering spaces. It's an exciting development that reflects how Brea continues to evolve.
